New York Sales Tax Economic Nexus & Remote Seller Rules
New York State enforces economic nexus under Tax Law § 1101(b)(8)(iv), administered by the New York State Department of Taxation and Finance (DTF). New York features one of the most distinctive threshold structures in the nation.
1. The "AND" Nuance: Both Revenue and Volume Required
In most states (like Illinois, Georgia, or New Jersey), the threshold is an "OR" rule ($100,000 OR 200 orders). In New York, it is an "AND" rule:
- If you sell $700,000 of high-end machinery across only 20 transactions in NY: No economic nexus.
- If you sell $50,000 across 300 orders of low-cost items: No economic nexus.
- If you sell $520,000 across 115 orders: Economic nexus triggered immediately.
2. The Immediately Preceding 4 Sales Tax Quarters
New York sales tax quarters run differently than standard calendar quarters:
- Quarter 1: March 1 through May 31
- Quarter 2: June 1 through August 31
- Quarter 3: September 1 through November 30
- Quarter 4: December 1 through February 28/29
Vendors must review their gross receipts and transaction volume for the immediately preceding four sales tax quarters at the conclusion of each quarter.
3. New York City & Local County Sales Taxes
New York State imposes a base sales tax of 4.00%. Local county and municipal taxes (including the Metropolitan Commuter Transportation District surcharge of 0.375%) typically raise the total combined rate to 8.00% to 8.875% (with New York City at 8.875%).
